Terms & Conditions

These terms govern your purchase and use of services from AscendCore Pty Ltd through this website, including pricing, payment, delivery, refunds, and privacy. By placing an order you agree to them.

AscendCore is a technology and software company providing ready-made digital products (including websites, CRM and business systems, automation and AI tools), plus custom software and technology consulting. In these terms, “we”, “us” and “our” mean AscendCore Pty Ltd, and “you” means the customer placing an order.

Services & pricing

The services we offer, with their descriptions and prices, are set out on our Services & Pricing page. Each engagement is also governed by our full Services Agreement, which you can read in full and download on that page.

Prices are indicative and may change from time to time. The price that applies to your order is the price shown at checkout when you pay, and is confirmed in writing in your tax invoice and, where relevant, a Statement of Work.

Payment, currency & GST

Delivery & fulfilment

We provide digital products and services delivered electronically by email; no physical goods are shipped.
Delivery timeframe
Ready-made digital products are delivered automatically to your nominated email address within 24 hours of payment.
Custom requests. Bespoke or customised work (including custom software and technology consulting) is invoiced directly and delivered within 5 business days, unless a longer timeframe is agreed with you in writing before you pay. If we cannot meet a delivery timeframe, we will contact you promptly to agree a revised timeframe or, where appropriate, provide a refund of any undelivered item.

We provide digital products and services delivered electronically by email; no physical goods are shipped.
Your Australian Consumer Law rights
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. If a product or service has a major failure, you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. If the failure is minor, we will repair, replace, or refund it within a reasonable time. These rights apply regardless of the policy below.
  • Before delivery: you may cancel your order for a full refund at any time before a ready-made product has been delivered to you.
  • Change of mind after delivery: because products are delivered digitally and immediately, we are not required to provide a refund simply for a change of mind once a product has been delivered. This does not affect your consumer guarantee rights above.
  • Faulty or not as described: if a product is faulty, not as described, or does not do what we said it would, you are entitled to a remedy under the Australian Consumer Law, including a refund for a major failure.
  • Custom requests: you may cancel for a full refund before we begin work; once work has commenced, fees for a change of mind are non-refundable, but your consumer guarantee rights still apply.
To request a cancellation or refund, email help@ascend-core.com.au with your order details. We will respond within five (5) business days. Approved refunds are returned to your original payment method. For more on your rights, see the ACCC at accc.gov.au.

Chargebacks

If you believe a charge is incorrect, please contact us first so we can resolve it quickly — most issues are sorted within a few business days. Initiating a chargeback without first raising a genuine dispute with us, or in bad faith, is a breach of our Services Agreement and we reserve the right to recover the charged-back amount, a $250 AUD administration fee per incident, processor fees, and reasonable legal costs.

Intellectual property

Subject to full payment, we assign to you the intellectual property rights in deliverables created specifically for you. We retain rights in our pre-existing tools, frameworks, methodologies, and platform, and grant you a non-exclusive licence to use any of our pre-existing materials embedded in your deliverables for your internal business purposes. Full detail is in our Services Agreement.

Privacy & data

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We collect the details you provide at checkout (such as your name, email, business name, and ABN) to raise your invoice, deliver your services, and meet our legal obligations.

For identity verification and fraud prevention only, you may be asked to upload a valid government-issued photo ID via our designated secure signing platform; this is stored securely and used only for that purpose. We do not sell your personal information. To access or correct your information, contact help@ascend-core.com.au.

Liability

To the extent permitted by law, our total liability for any claim is limited to the charges you paid in the three (3) months before the claim, and we are not liable for indirect or consequential loss including loss of profits, revenue, or data. This does not exclude rights under the Australian Consumer Law that cannot be excluded.

Governing law & disputes

These terms are governed by the laws of New South Wales, Australia. We aim to resolve any dispute through good-faith discussion first; unresolved disputes may be referred to mediation administered by the Australian Disputes Centre before either party commences proceedings in the courts of New South Wales.
